Terms of Service

By accessing or using SelahOS ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Emotion Media, located at Costa Mesa, California 92626.

By creating an account and checking the acceptance box at registration, you affirmatively consent to all terms in this agreement, including our data collection and use practices as described herein and in our Privacy Policy.

SelahOS is a personal operating system that connects your tools (email, calendar, project management, messaging, documents) and surfaces prioritized intelligence via an AI assistant, automated briefs, and a persistent memory layer ("the Brain"). The Service is designed for individual professionals, operators, consultants, and teams who want a unified view of their work and life.

You must create an account to use SelahOS. You agree to:

• Provide accurate, complete, and current registration information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized access to your account
• Be at least 18 years of age
• Use the Service only for lawful purposes and in accordance with these Terms

You are responsible for all activity that occurs under your account. Emotion Media is not liable for any loss resulting from unauthorized use of your account.

Free Trial: New accounts receive a 7-day free trial. No credit card is required to start. At the end of the trial period, continued use requires a paid subscription.

Subscription Plans: SelahOS offers two plans — Selah Solo and Selah Pro. During the private beta, members pay beta pricing in effect at the time of subscription. Beta pricing may close after 1,000 users, after which prices may increase for new members. Your rate is locked at the price in effect when you subscribe, for as long as your subscription remains active and uninterrupted.

Billing Cycle: Subscriptions are billed monthly in advance. All fees are non-refundable except as outlined in our 30-day money-back guarantee.

30-Day Money-Back Guarantee: If you are not satisfied with SelahOS within 30 days of your first paid charge, contact us at support@emotionmedia.io for a full refund.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to the Service until that date.

Price Changes: We will provide at least 30 days' notice of any price changes via email. Your locked rate will not be affected by general price increases for as long as your subscription remains active.

SelahOS includes an AI-powered memory and intelligence layer ("the Brain") that learns from your usage over time. By using the Service, you acknowledge and consent to the following:

What the Brain collects:

• Entity data: People, companies, projects, and relationships you reference in the Service — extracted and stored to personalize your experience
• Behavioral patterns: How you prioritize, what you act on, what you defer, how you communicate, and how you make decisions — learned over time to improve the intelligence the Service provides to you
• Interaction signals: Which content you engage with, what you ignore, how long you spend on certain tasks, and what types of suggestions you act on
• Content extractions: Tasks, decisions, action items, and key facts extracted from your uploaded files, meeting notes, voice captures, and brain dumps
• Temporal patterns: When you are productive, what triggers action, and how your behavior changes over time

This data is used to personalize your experience, improve the quality of your AI responses and briefs, and develop the intelligence layer of the Service. You own your data. We process it to serve you.

By using the Service, you grant Emotion Media a perpetual, worldwide, royalty-free license to:

• Process and store your data to provide and improve the Service
• Use anonymized, de-identified, and aggregated data derived from your usage — and the usage of all users — for the following purposes:

Permitted uses of anonymized and aggregated data:

• Product improvement: Improving AI models, features, and algorithms within SelahOS
• Research and analytics: Conducting internal or published research on productivity patterns, professional behavior, and workflow intelligence
• Business partnerships: Sharing aggregated, anonymized datasets with vetted third-party research institutions, enterprise partners, or technology companies for research and development purposes
• Commercial data products: Creating and licensing aggregated behavioral intelligence products to third parties, including potential strategic partners or acquirers
• Business transactions: In connection with a merger, acquisition, asset sale, or similar transaction, aggregated data may be transferred as a business asset

What we will never do:

• Sell, license, or transfer your personally identifiable information (your name, email address, or data linked to your specific identity) to third parties for advertising or marketing purposes without your explicit, separate consent
• Share your raw, identified content — your actual emails, messages, or documents — with any third party without your explicit consent
• Use your individual data to make decisions that adversely affect you without disclosure

The distinction that matters: "Aggregated and anonymized data" means data that has been stripped of all personally identifiable information and combined with data from other users such that no individual can be identified. This is fundamentally different from your personal data, and its use is standard practice among technology platforms under applicable law.

You may request deletion of your personal data at any time (see Section 12). Upon deletion of your account, your personally identifiable information will be removed. Anonymized, aggregated data derived from your usage may be retained as part of collective datasets.

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit malware, spam, or malicious content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or disassemble the Service
• Use the Service in any way that could damage, disable, or impair it
• Share your account credentials with others outside your authorized subscription
• Use automated bots or scripts to generate excessive API usage beyond normal human use patterns
• Upload or process content that violates the intellectual property rights of any third party

We reserve the right to implement fair use limits and to suspend or throttle accounts that engage in usage patterns inconsistent with normal human use.

The Service integrates with third-party platforms (Google Workspace, Slack, Notion, ClickUp, Linear, and others). By connecting these integrations, you authorize SelahOS to access and process data from those services on your behalf, subject to each platform's own terms of service.

You may revoke integration access at any time from within your account settings or from your connected platform's own access controls. Revoking access may limit Service functionality.

Emotion Media is not responsible for the availability, accuracy, or policies of third-party platforms.

Our IP: SelahOS, its interface, design, codebase, AI systems, Brain architecture, and content are owned by Emotion Media and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain full ownership of all personal data, content, and information you provide to or access through the Service. You grant Emotion Media a limited, non-exclusive license to process and display your content solely to provide the Service to you.

Derivative Intelligence: Anonymized and aggregated analytical products, behavioral models, and intelligence datasets derived from collective user data — with all personal identifiers removed — are the intellectual property of Emotion Media. This does not affect your ownership of your personal data.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes in detail how we collect, use, store, and share your information. By agreeing to these Terms, you also agree to the Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. EMOTION MEDIA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

AI-GENERATED CONTENT IN THE SERVICE IS FOR INFORMATIONAL AND PRODUCTIVITY PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS LEGAL, FINANCIAL, MEDICAL, OR PROFESSIONAL ADVICE.

THE BRAIN SYSTEM'S BEHAVIORAL INSIGHTS AND PATTERNS ARE PROBABILISTIC IN NATURE AND MAY NOT ACCURATELY REFLECT YOUR INTENTIONS OR CIRCUMSTANCES. YOU ARE RESPONSIBLE FOR ALL DECISIONS MADE USING THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMOTION MEDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You may request access to, correction of, or deletion of your personal data at any time by contacting us at support@emotionmedia.io or through your account settings.

Upon verified deletion request, we will remove or anonymize your personally identifiable information within 30 days. Aggregated and anonymized data derived from your usage may be retained as part of collective, non-identifiable datasets consistent with Section 6 of these Terms.

California residents may exercise additional rights under the California Consumer Privacy Act (CCPA). EU/EEA residents may exercise rights under the General Data Protection Regulation (GDPR). See our Privacy Policy for full details.

You agree to indemnify and hold harmless Emotion Media and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your account at any time for violation of these Terms, non-payment, abusive usage patterns, or any other reason we determine appropriate. Upon termination, your right to access the Service ceases immediately.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, California.

Before initiating any legal action, you agree to contact us at support@emotionmedia.io and attempt to resolve the dispute informally for at least 30 days.

We reserve the right to update these Terms at any time. We will notify you of material changes by email or through a prominent notice in the app at least 7 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
